MIKHAIL EVRAEV TOOK PART IN THE CONFERENCE - “PUBLIC PROCUREMENT DURING THE PANDEMIC”

The National Conference was organized extraordinarily due to the urgency of the questions facing customers and entrepreneurs with regard to application of Nos. 44-FZ and 223-FZ Federal Lawsduring the COVID-19 pandemic

 

More than 9 000 persons, representing both customers and businesses from all regions of Russia took part in the specialized video-Conference.

 

Deputy Head of FAS Mikhail Evraev outlined the joint standpoint of FAS, the Ministry of Finances and the Ministry of Emergencies of Russia.

 

According to the three bodies, propagation of the new coronavirus infection is an extraordinary circumstance, unavoidable under the given conditions and it constitutes a force majeure event, therefore, customers can buy goods, works and services from the single supplier in accord with Clause 9 Part 1 Article 93 of № 44- FZ Federal Law.

 

At the same time, customers can procure from the single supplier when there are cause-and-effect relationships between the procurement items and the force majeure event.

 

As emphasized by Mikhail Evraev, FAS has introduced remote consideration of complaints through video-conferencing for all procurements under Nos. 44-FZ and 223-FZ Federal Laws, as well as industry-specific tenders and petitions for entries in the Register of Unfair Suppliers.

 

Remote consideration of complaints and petitions is introduced for both the Central FAS Office and regional FAS Offices all over Russia.

 

The Federal Antimonopoly Service also explained how electronic sites will operate in April 2020.

 

“Since procurement cannot be stopped for a month, electronic sites will support the work of customers and businesses under №44-FZ Federal Law as well as №.223-FZ Federal Law till the end of April 2020 in the ordinary course”, explained Mikhail Evraev.
