THE FAS RUSSIA: IT IS IMPORTANT TO HOLD PUBLIC DISCUSSIONS IN THE LEGISLATIVE WORK IN ORDER TO HEAR DIFFERENT POSITIONS AND OPINIONS

On October 22, the 17th meeting of the Scientific and Methodological Council of educational organizations and departments of competition law and antimonopoly regulation of the FAS Russia was held

The event was moderated by Sergey Puzyrevsky, Deputy Head of the FAS Russia.

Head of the Legal Department of the FAS Russia spoke about the work of the Scientific and Methodological Council.

In our work history, we have approved work programs that are essential for the preparation of educational programs in educational institutions, said Artem Molchanov. – In 2020, we have new departments: this is the Kabardino-Balkarian State Agrarian University, in which the Basic Department of Antimonopoly Regulation has been created, as well as the Department of Business Law, Competition Law and Antimonopoly Regulation at the Griboyedov Institute of International Law and Economics.”

Also during the last 2 meetings, members of the Scientific and methodological Council discussed the implementation of the National competition development plan for 2018-2020, the draft of the new National plan for 2021-2025, and the concept of the Road Map in the field of science and education (it is in the final stage of development before being submitted to the Government of the Russian Federation).

“This year we approved the work program of the discipline Procedures in Competition Law. 2 monographs were published, which were attended by experts of the Council-a collection of the results of the conference in Skolkovo and the monograph Assessing the State of Competition in Commodity Markets: Legal and Economic Issues following the conference in St. Petersburg,” the speaker announced.

Artem Molchanov announced an expanded meeting of the Council within the framework of the International Conference in Skolkovo, which will take place in November.

“The Scientific and Methodological Council carries out quite a lot of work, and I thank the members of the Council for their active position and assistance in coordinating scientific and educational activities and developing new innovative solutions in the field of antimonopoly regulation and education,” Sergey Puzyrevsky said.

Also Artem Molchanov spoke about the directions of the development of antimonopoly law.

“The State Duma is considering a draft law on amendments to Article 1360 of the Civil Code of the Russian Federation, giving the Government of the Russian Federation the right to decide on the use of the results of intellectual activity without the consent of the patent holder in cases of threats to the life and health of citizens. Besides, 3 draft laws prepared within the framework of the national Plan are in a high state of readiness in the Government, they relate to digitalization, natural monopolies and state regulation of prices (tariffs),” Artem Molchanov said.

A co-speaker on this issue was Denis Gavrilov, Deputy Head of the Department of Competition Law of the University named after O.E. Kutafina (Moscow State Law Academy), Advisor to the antimonopoly practice of Egorov Puginsky Afanasiev & Partners.

“We have a huge field for research and consulting work and assistance to subjects in the implementation of these areas. It is also very important for us to hold public discussions of draft laws so that there are different positions and opinions. The presence of discussions, monographs, publications let us understand the vectors of development of antimonopoly legislation. Together, these bills create a new reality of antimonopoly regulation,” Artem Molchanov said.

When discussing the issue of codification of antimonopoly law, Sergey Puzyrevsky noted: “I believe that this is the right direction, but not an easy one. We have a concept of codification of Antimonopoly legislation, and the grounds for it, but we must take into account the risk of not only improving, but also worsening the regulatory system. In the process of reform, we can both gain and lose. Maybe in 5 years or later, we will come to this, which will allow us to systematize the normative material. While we are engaged in improving the antimonopoly and tariff law”.

The discussion participants discussed the preparation of clarifications On the Specifics of the Implementation of State Antimonopoly Control over Economic Concentration, the work on which was started last year. Artem Molchanov thanked the Association of Antimonopoly Experts for assistance in preparing the document.

Irina Knyazeva, Head of the Research Laboratory Center for Competition Policy and Economics, Professor of the Management Department of the Siberian Institute of Management - a branch of the RANEPA, devoted her speech to the institutionalization and content of the categories of positive effects in concentration transactions.

Dmitry Shalabodov, Head of the Sverdlovsk Regional Office of the FAS Russia and Igor Veretennikov, Head of the Tyumen Regional Office of the FAS Russia, spoke about practical issues of calculating fines for entering into anti-competitive agreements at tenders.

Tatyana Volkova, Associate Professor of the Department of Land and Environmental Law of the Saratov State Law Academy, member of the Scientific Advisory Council of the Chamber of Commerce and Industry of the Saratov District, noted the topical issues of the practice of applying antimonopoly legislation regulating the natural resources market and environmental management.

Natalya Kukharskaya, Head of the Kemerovo Regional Office of the FAS Russia, Head of the Department of Competition and Antimonopoly Regulation of the Kuzbass State Technical University, and Lyudmila Borisova, Deputy Chairman of the Council, Head of the Saratov Regional Office of the FAS Russia, made a presentation On the Issue of Establishing a Base Tariff for the Movement and (or) Storage of Detained Vehicles in the Absence of Information Confirming the Economically Justified Expenses of the Subjects of Regulation.

Igor Veretennikov, Head of the Tyumen Regional Office of the FAS Russia, spoke about the work of the base department of competition law and antimonopoly regulation of Tyumen State University.
