KIROV ADMINISTRATION COMPLIED WITH THE ORDER OF THE FAS RUSSIA
The authority's response act was related to the restriction of competition in the water supply and sanitation market
The Kirov city Administration fully complied with the order of the Antimonopoly Service. The authority issued it in June 2020 due to the fact that the city administration restricted the access of economic entities to the market for the provision of water supply and sanitation services and thereby violated the Law on Protection of Competition [1]. The Administration refused to provide the necessary information and materials to a potential investor to participate in the tender for the right to conclude a concession agreement, which limited competition in the water supply and sanitation market.
In compliance with the order, the city Administration considered the request of Kirov Municipal Systems JSC for the submission of materials and documents necessary for the preparation of a proposal for the conclusion of a concession agreement on the initiative of a potential investor.
Besides, the Kirov Administration approved a list of housing and communal services facilities for which it is planned to conclude concession agreements, and posted this list on the website torgi.gov.ru, as well as on its official website.
Futhermore, in compliance with the order, the municipality announced on its website that it is ready to consider proposals from potential investors to conclude concession agreements in respect of municipal water supply and sanitation facilities, including those under the economic management of municipal unitary enterprises.
Earlier, the Kirov Administration tried to appeal the order of the Authority, but the courts of first and appeal instances upheld the position of the FAS Russia.
