FAS REFUSED TO AGREE ON PETITION FOR THE ACQUISITION OF BARZASSKIY KAR'YER LLC

According to the FAS, the transaction might result in a restriction of competition in the crushed stone market

The group of persons of Nacional'naya nerudnaya kompaniya JSC (NNK) is one of the largest producers of crushed stone in the Central, Northwestern, Volga and Siberian Federal Districts.

Barzasskiy karyer LLC is also one of the largest producers of crushed stone in the Siberian Federal District. A competitor comparable in terms of crushed stone extracted is Pervaya nerudnaya kompaniya JSC. The shares of other players in the crushed stone market from igneous rocks of the Federal District do not exceed 8%.

If a transaction stated in the petition took place, the combined market share of the group of persons of NNK JSC and Barzasskiy karyer LLC in the crushed stone market of the Siberian Federal District would be 48% in terms of sales.

According to the FAS Russia, the transaction might result in a restriction of competition in the crushed stone market and the emergence of a dominant position of the NNK group of persons.
