THE COURT SUPPORTED THE FAS RUSSIA IN THE DISPUTE WITH TELE2

From May 12, 2020, the company increased the cost of mobile communication services on separate tariff plans

The Moscow Arbitration Court confirmed the legality of the decision and order of the FAS Russia in relation to T2 Mobile LLC, as well as the legality of the imposition of a fine against the company.

It should be reminded that in May 2020, the company increased the cost of cellular services by an average of 12% for a quarter of its subscribers. The operator justified these actions by increasing the growth of its costs.

The FAS Russia found that T2 Mobile LLC set monopolistically high prices for its services, and issued an order to bring tariffs to the level before the increase. The company appealed to the court, but the position of the antimonopoly authority was supported.

According to paragraph 1 of Part 1 of Article 10 of the Law on Protection of Competition, actions (lack  of  action)  of  an  economic  entity  occupying  a dominant  position, which results or can result in prevention, restriction or elimination of competition and (or) infringement of the interests of other persons(economic entities) in the sphere of  entrepreneurship  activity  or  indefinite  range  of  consumers are  prohibited, including the imposing contractual terms upon a counteragent which are  unprofitable for the latter   or   not   connected   with   the   subject   of   agreement   (economically   or technologically unjustified and (or) not provided for directly by the Federal Laws, statutory legal acts of the President of the Russian Federation, statutory legal acts of the  Government  of  the  Russian  Federation,  statutory  legal  acts  of  the  authorized federal executive authorities or judicial acts, requirements for transferring financial assets,  other  property,  including  property  rights,  as  well  as  consent  to  conclude a contract on conditions of including in its provisions, concerning the goods.
