Report cartel collusion!

 

When companies operating in the same market make arrangements about unified pricing policy, conditions for participating in bidding and tenders, dividing markets and clients between themselves – they participate in cartel collusion!

 
Russian law prohibits cartel collusions (agreements or concerted actions, competition-restriction actions – Article 11 of No.135-FZ “On Protection of Competition” of 26th July 2006).
 
Article 14.32 of the Code of the Russian Federation on Administrative Violations establishes administrative liability for participation in cartel collusion.
 
- for officials – an administrative fine from RUB 20,000 to RUB 50,000 or disqualification for a period of up to three years;
- for legal entities – an administrative fine of 1 to 15 % of the violator’s income from selling goods (works, services) on the market where the violation was committed (a “turnover” fine).
 
If companies – participants of a cartel collusion have caused heavy damages (more than RUB 1 million) to citizens, organizations or the state, or have gained large income (more than RUB 5 million), under Article 178 of the Criminal Code of the Russian Federation companies’ executives shall be held criminally liable, with penalties including:
 
- a fine of up to RUB 1 million;
- a fine in the amount of income of the convicted person for up to five years;
- imprisonment for up to seven years.
 
If YOU or YOUR COMPANY is a PARTICIPANT of a CARTEL COLLUSION, report it to the Federal Antimonopoly Service. The first cartel member, who reports the cartel to the antimonopoly authority and voluntarily refuses to participate in it, is fully relieved from liability! (See the Notes to Article 14.32 of the Code of the Russian Federation on Administrative Violations).
 
If unfair competitors entered into collusion and interfere with your company - report it to the Federal Antimonopoly Service. The antimonopoly authority will check their activities and you will gain competitive advantage.
