FAS: violations at the auctions for two subsoil plots at Veduginskoe gold deposit

The auction organizer unlawfully rejected a bid

FAS investigated two complaints of “West-Siberian Oil-and-Gas Company” Ltd. against the Subsoil Use Department of the Central Siberian District.

The Department organized two auctions for subsoil use in the North-West and Strelka plots of Veduginskoe gold deposit in the Krasnoyarsk region. According to the claimant, the auction organizer unlawfully rejected its auction bids.

Upon investigating the complaints, FAS concluded that refusal to accept the bid of “West-Siberian Oil-and-Gas Company” Ltd. was unlawful due to several reasons.

For example, the department rejected the company’s bids because they lacked staff schedules of the contractors, that the claimants planned to engage in some works on the deposit. At the same time, under the current law, information about the staff of the bidders at the subsoil use auctions, which must be submitted to the auction organizers, can be disclosed in a staff schedule as well as in other documents.

Head of FAS Department for Control over Construction and Natural Resources, Olegl Korneev, explained: “West-Siberian Oil-and-Gas Company” submitted sufficient documents to the Department enabling to reach the conclusion about its personnel capacity, including copies of diplomas and labour record books of the engaged specialists. Therefore, rejection of the company’s bid was unlawful”.

After investigating the complaints, the antimonopoly body found that the Subsoil Use Department of the Central Siberian District violated Part 1 Article 14 of the Subsoil Law.
