AN ANTIMONOPOLY BODY OPENED ANOTHER CASE AGAINST PRIMORSK PORT
Primorie Commercial Port failed to execute a warning issued by Leningrad OFAS to stop violating the ant6imonoply law
Primorsk Port was imposing disadvantageous conditions on mandatory compliance with the “Guidelines for vessel handling at the marine terminal, operated by “PTP” Ltd.”
The warning, issued upon a request from “Rosnefteflot” JSC, requested to remove a clause on performing mooring operations exclusively by “PTP” Ltd. from the standard draft contract. It was also necessary to exclude the wordings on undertaking obligations to observe the Guidelines by companies operating in the port waters.
On the final day of the warning-execution period, the antimonopoly body received a confirmation from Primorsk Port on removing the provision about performing mooring operations by tugs of “PTP” Ltd. At the same time, regarding the Guidelines the stevedore mentioned that the company did not see any violation of the law in its actions.
Thus, the warning was not executed. Leningrad OFAS opened a new antimonopoly case against “PTP” Ltd. upon sings of breaching Clause 3 Part 1 Article 10 of No.135-FZ Federal Law.
