FAS keeps receiving questions from individuals and organizations about control over foreign investments.
The most frequent questions in Q1 2018 included:
- “Preliminary” procedure of approving transaction when a Russian citizen voluntarily left the company, as a result of which a foreign national gained the right to dispose of more the 50% of the total votes
- Obligation of a custodian bank to get consent for acquiring over 50% voting shares of a foreign company, which, in its turn, owns 100% voting shares of an economic entity of strategic importance
- Establishing indirect control transferring shares to “trust”.
