THE STATE DUMA IN THE FIRST READING ADOPTED FAS DRAFT LAW ON FLAT DUTY RATE FOR CONSIDERING PRETRIAL DISPUTES IN THE FIELD OF TARIFF REGULATION

The duty rate shall be 120 000 RUB

 

Before April 2018, Russia had ten different procedures for considering tariff disputes and disagreements, specified in five acts of the Government of the Russian Federation. A regulated entity could approach FAS for the same issue, using, however, different procedures with different periods of limitation and decision-making procedures.

 

For performing the same legally significant actions, FAS had two different state duties: 80 000 RUB for considering disagreements and 160 000 RUB for considering prejudicial disputes.

 

On 30 April 2018, the Government approved common rules for considering disputes and disagreements related to setting and applying tariffs and abolished ten procedures that had various contradictions.

 

Deputy Head of FAS Sergey Puzyrevskiy informed: “Therefore, the document unified the procedure for considering such disputes and disagreements. The provisions of the Tax Code that determined the size of the state duties remained unchanged and unreasonably differentiated. To improve the law of the Russian Federation FAS drafted amendments to the Tax Code.

 

The document sets unified state duty – 120,000 RUB – for making decisions by the antimonopoly body on petitions to consider disputes and disagreements related to fixing and applying prices. It is expected, that the budget of the Russian Federation can gain more than 27 million RUB”, said Deputy Head of FAS.

 

On 11 October 2018, the State Duma of the Russian Federation adopted FAS draft law in the first reading.

 

“The document drafted by the antimonopoly authority is an element of a package of measures designed to unify the law on tariff regulation”, stated Sergey Puzyrevskiy.
