Information on Detecting Violations of Antimonopoly Legislation by the Federal Antimonopoly Service
On the basis of the Authority’s annual reporting, the Federal Antimonopoly Service has prepared the consolidated data on the main results of the antimonopoly bodies’ activities for the year of 2012.
In general, the received data demonstrate that the tendency towards decrease in number cases initiated on the grounds of violations of the antimonopoly legislation, including Article 10 of the Federal Law “On Protection of Competition”, in where Paragraphs 3 and 5 of Part 1 of this Article provides for the issuing of warnings before case initiation.
In 2012, the Regional Offices of the FAS Russia began to apply the new legal institution of warnings and admonitions. According to the results of 2012, the antimonopoly bodies issued 1423 warnings on termination of actions (omission to act), which contain signs of violations of the Federal Law “On Protection of Competition” and 73 admonitions on prohibition to violate the antimonopoly law.
In 2011, the number of considered pre-merger and post-merger notifications dropped in half due to the triple lowering of the number of submitted notifications.
According to the data of the Federal Treasury (the Treasury of Russia), the fines in the amount of 7 bn. Rubles were transferred in favor of the budget of the Russian Federation for violations of antimonopoly legislation in 2012.
