of the Russian Federation

Article 1

1) Note 4 to the Article 14.32 extend by the item 3:

"3) usage by a person who has committed an administrative offence, for the purpose of executing anticompetitive agreement, the responsibility for the conclusion of which is provided for by the Parts 1 and 2 of this Article, of a program for computers that allows decision-making (performance of actions) aimed at the execution of anticompetitive agreement in an automatic mode (without human intervention)";

 

2) Article 19.5 extend by the Part 28:

"28. Failure to comply with the ruling (remedies) of the federal antimonopoly authority, its regional office within the prescribed period by a person who has previously been subjected to administrative liability provided for by this Part or Parts 21 - 27 of the given Article, for failure to comply with the ruling (remedies) in case the antimonopoly authority, its regional office has established new deadlines for the execution of the ruling (remedies):

– entails disqualification of designated person for a period of one to three years; imposition of an administrative fine on the legal entity in the amount of twice the amount of the previously imposed administrative fine for committing administrative offence provided for by this Part or Parts 21 - 27 of the given Article, but not more than one fiftieth of the total amount of the offender's proceeds from the sale of all goods (works, services) for the calendar year preceding the year in which the administrative offence was found, and not less than one hundred thousand rubles";

 

3) in the Part 2 of the Article 23.1 numbers "26, 27, 3" substitute with "26 - 3";

 

4) in the Part 1 of the Article 23.48 numbers "27" substitute with "28".

 

Article 2

The given Federal Law enters into force on September 1, 2023.
