FAS proves that gravel prices in Crimea were fixed unlawfully

Moscow Arbitration Courtpronounced legitimacy and reasonableness of the decision issued by the Federal Antimonopoly Service (FAS Russia) on a case against “Sharkhinsky Quarry” JSC.

In June 2015 FAS found that “Sharkhinsky Quarry” JSC violated the antimonopoly law in the part of abusing dominance on the market of high-impact gravel, 1200-1400 grades, in the Crimea Federal District (Clause 6 Part 1 Article 10 of the Federal Law “On Protection of Competition”).

The Antimonopoly Service established that in April - October 2014 “Sharkhinsky Quarry” JSC was selling gravel using two price-lists: for in-house customers – members of the same group of companies, and for external buyers – for all others. The price difference reached 25%.

The company filed a lawsuit to invalidate and reverse the FAS decision.

Moscow Arbitration Courtdismissed the claim, confirming the conclusions made by the antimonopoly authority.
