FAS explained applying the Law “On Protection of Competition” in innovative sectors

FAS Presidium approved the explanations on agreements in innovative and hi-tech sectors.

The main objective is to clarify enforcement practice of the antimonopoly law with regard to such agreements.

The explanations emphasize that Article 11 of the Federal Law “On Protection of Competition”establishes an absolute prohibition of collusions eliminating competition on the market.

Taking into account the importance of agreements in innovative and hi-tech sectors aimed at integrated and progressive development of the economy, the antimonopoly law allows for some types of arrangements (Article 13).

If the result of actions is aimed at improving production, stimulating technological and economic progress, enhancing competitive ability of Russian goods on the global market, and does not eliminate competition, such arrangements can be allowed.

FAS passed an Order (1) approving the list of documents and information that economic entities must submit to the antimonopoly body when intended to conclude an agreement
