FAS warns: avoiding contracts for heat supply is unlawful
The Antimonopoly Service warned “T Plus” PJSC: the company is avoiding a heating supply contract with “Enel Russia” OJSC.
Under the current law on heating supply, integrated heating suppliers must conclude contracts for heating energy supplies on the load volume, determined in accord with the heating supply pattern. “T Plus” PJSC is an integrated supplier and has the dominant position on the regional heat energy market.
The Federal Antimonopoly Service considered a petition of “Enel Russia” OJSC and found that actions of “T Plus” PJSC had elements of violating Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition”.
In accord with the warning, “T Plus” should conclude a het supply contract with “Enel Russia” OJSC within ten working days from the date of receiving it.
“Avoiding heating supply contracts in breach of the current law is unacceptable and threatens reliability and quality of heating supply for consumers. If “T Plus” PJSC fails to execute the warning, FAS shall open a case upon elements of the antimonopoly law”, commented Deputy Head of FAS Department for the Housing & utilities Sector, Elena Tsyshevskaya.
