“Yantarenergo” JSC lost a lawsuit to Kaliningrad OFAS
On8 September 2016, the Federal Arbitration Court of the North-Western District confirmed a fact of violating Part 1 Article 10 of the Federal Law “On Protection of Competition” by “Yantarenergo” JSC.
The operative part of the ruling was announced on 7 September 2016: the Court fully recognized legitimacy and reasonableness of the arguments that Kaliningrad OFAS had put forward in the case. The antimonopoly body established that for a long time the company avoided properly reregistering documents on technological connection to electric power networks for “Nemanskaya Tsellyuloza” Ltd. It breached the interests of “Nemanskaya Tsellyuloza” Ltd. as well as the “Rules for non-discriminatory access to the services for electric power transmission and rendering such services”.
Having investigated the case, “OFAS issued a determination to stop the violation and redraw the documents on technological connection of power-receiving devices.
“Yantarenergo” JSC disagreed with the decision made by the antimonopoly body and filed a lawsuit to Kaliningrad Regional Arbitration Court. On 23 November 2015 the Court dismissed the claim.
On 4 May 2016, the 13th Arbitration Appeal Court also dismissed the claim.
“During its persistence, “Yantarenergo” JSC was fined 100,000 RUB for failure to execute determinations of Kaliningrad OFAS, and for more than 300,000 RUB for abusing dominance”, clarified the Head of Kaliningrad OFAS, Olga Bobrova.
