Forecast weather, not prices
On 12 September 2016, the Federal Antimonopoly Service (FAS Russia) warned the President of the “Moscow Fuel Association” Non-Profit Organization, the President of the “Russian Fuel Union” Non-Profit Organization Evgeny Arkusha that actions leading to violations of the antimonopoly law are unacceptable.
Evgeny Arkusha, in particular, made a public statement on growing prices for gasoline that could have resulted in demand – supply misbalance on the domestic market of oil products in the Russian Federation (the comments in the article “Prices will flow. Gasoline is expected to become more expensive in October” of 7 September 2016 and the article “Gasoline costs are going to rise in October due to the increased excise duties” of 8 September 2016).
Article 25.7 of No.135-FZ Federal Law “On Protection of Competition” prohibits actions that can lead to violating the antimonopoly law.
Under Part 5 Article 11 of No.135-FZ Federal Law “On Protection of Competition” prohibits physical persons, commercial organizations and non-profit organizations to coordinate economic activity of economic entities if such coordination leads to any of the consequences specified in Parts 1 - 3 Article 11, that cannot be allowed under Articles 12 and 13 Federal Law “On Protection of Competition” or that are not provided for by the federal laws.
