Artem Molchanov: FAS explanations will help businesses avoid antimonopoly risks

On 23 September 2016, the Head of the Legal Department of the Federal Antimonopoly Service (FAS Russia) Artem Molchanov was a speaker at the conference of the Corporate Counsel Association  on “Liability: How to Be Held Liable and to Avoid It. The Risk Zones: what should corporate counsels pay attention to”.

Attendees included around 150 chief counsels and senior lawyers of the legal departments of Russian and international companies – members of the Corporate Counsel Association.

Starting his presentation, Artem Molchanov stated that this year the legal status of FAS Presidium is determined. It studies, summarizes and gives explanations on antimonopoly enforcement practice. Its work procedure is approved by an order of the antimonopoly authority registered with the Ministry of Justice of the Russian Federation.

Since January 2016 FAS Presidium issued 6 explanations that will help businesses to avoid errors in antimonopoly law enforcement.

Artem Molchanov gave examples of the best foreign practices and FAS plans in the regulatory field.

He also outlined FAS joint efforts with the Corporate Counsel Association, under the frame of which draft explanations on “Abusing Dominance” are being prepared.

Alexandra Nesterenko, the President of the Corporate Counsel Association (CCA), expressed hopes that the document, drafted by a Joint Working Group of CCA and FAS, will add to clarity of businesses applying the norms of Article 10 of the Federal Law “On Protection of Competition” and this positive experience of cooperation between corporate counsels and the antimonopoly authority will be continued to establish transparent and understandable regulatory rules.

Finally, Artem Molchanov thanked members of the Corporate Counsel Association for their efforts towards improving the antimonopoly law and asked to elaborate, jointly with FAS, on the currently central issues of competition policy in view of foreign experiences and the best practices.
