An attempt to appeal FAS warning was to no avail
The 9th Arbitration Appeal Court dismissed an appeal of the Commission on devising a regional mandatory medical insurance programme in St Petersburg (the St Petersburg Commission on Mandatory Medical Insurance) supporting the position of a lower Court. Thus, a FAS warning issued to the St Petersburg Commission on Mandatory Medical Insurance remains in force.
In April 2016, investigating the antimonopoly case, FAS issued a warning to the St Petersburg Commission on Mandatory Medical Insurance to terminate actions that have signs of creating discriminatory conditions for “CardioClinika” CJSC on the market for medical services within the mandatory insurance system. Another warning on the same case was forwarded to the St Petersburg Government.
The Commission disagreed with the conclusions of the antimonopoly authority and filed a lawsuit. Moscow Arbitration Court, however, refused to consider the case. One of the main arguments for the Court was that the St Petersburg Commission on Mandatory Medical Insurance is not an independent legal entity and, therefore, cannot participate in judicial proceedings or bring suites on its behalf.
