Andrey Kashevarov: the case against “Apple Rus” Ltd. will be considered on 17 January 2017
The company is suspected of abusing dominance
According to a complaint received by the Federal Antimonopoly Law (FAS Russia),in 2016 service centres refused to replace a damaged display on Apple iPhone 6 Plus smartphone under an excuse that these spare parts are not supplied to Russia and offered the smartphone owner to make replacement for a fee.
The antimonopoly authority established that actions by “Apple Rus” Ltd.– the only supplier of the products of “Apple inc” to Russia, have elements of violating Part 1 Article 10 of the Federal Law “On Protection of Competition”: failure to support use of the products of “Apple inc” (iPhone 6, iPhone 6 Plus, iPhone 6s, iPhone 6s Plus) during their service life. The company does not supply components required for repair (screen modules and mother boards) to the Russian Federation), as a result it infringes the interests of consumers.
“Should facts of violating the law be confirmed, under Part 1 Article 14.31 of the Code on Administrative Violations, corporate top executives can be fined from 5000 to 20,000 RUB, and companies – from 300,000 to 1 million RUB”, said Deputy Head of FAS Andrey Kashevarov. “The case opened against “Apple Rus” Ltd. upon signs of violating Part 1 Article 10 of the Federal Law “On Protection of Competition” will be heard on 17 January 2017”.
