Komi OFAS issued a warning to a “North-West” branch of “MRSK” PJSC
The antimonopoly body exposed elements of violating the antimonopoly law
Komi OFASwas approached by “Vega” Ltd.The claimant stated that is involved in constructing a new apartment house. To supply electricity to the apartment house under construction, “Vega” filed an application to a grid company for concluding a technological connection contract. Having obtained a draft contract and technical specification, the claimant expressed its readiness to independently build up a two-transformer substation to reduce the payment for technological connection. In an additional agreement, “Komienergo” amended the contract, excluding from it construction of the two-transformer substation, thus, shifting that obligation to “Vega” Ltd.The costs of technological connection did not go down, as the claimant expected, and on the contrary increased by 1.5 million RUB (initially the payment was 8,624,447.24 RUB and it later became - 10,109,417,89 RUB)
Having studied the obtained materials, OFAS established that calculating the technological connection fee, the grid company wrongly applied the standardized tariff rates, approved by the Federal Tariff Service and the Tariff Service of the Komi Republic, which led to the excessive payment for technological connection. “Komienergo” received a warning to stop the above actions. Should the grid company fail to execute the warning, Komi OFAS shall initiate an antimonopoly case under Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition”.
