FAS issued a warning to “Rosneft” and “Gazprom”
On 27 January 2017, the Federal Antimonopoly Service (FAS Russia) issued warnings to “Rosneft” NK” PJSC and “Gazprom Gazenergoset” JSC. The companies created discriminatory conditions and infringed the interests of consumers at large through failure to meet the Regularity and Evenness Criteria1 for selling commodities on particular markets where oil and oil products circulate.
According to the warning, the companies must undertake the following measures by 6 February 2017 to eliminate the consequences of the violation:
1. Executing Part 5 Article 6 of the Federal Law “On Protection of Competition”, including:
- the Joint Order in the part of selling motor petrol through exchange trading – no less that 10% of motor petrol produced in the relevant month from refinery bases, and ensuring equal, non-discriminatory conditions in terms of the delivery methods – both railways and the main pipelines
- the Regularity and EvennessCriteria for selling commodities, in the part of allocating the annual scope of exchange trading with oil and (or) oil products by each type of the relevant exchange commodities sold by the companies or their agents through the Exchange, by the months of a calendar year, no less than the value set by the Joint Order, evenly by days, trading sessions and delivery bases.
2. Executing the requirements set in the Standard in terms of the principles for selling motor petrol on the domestic markets of the Russian Federation (Clauses 3.1 and 3.3 Section 3 of the Standard).
