“TNS Energo Nizhny Novgorod” PJSC was not able to invalidate the basic pricing principles of tariff regulation in the electric power industry
Judicial Collegium on Administrative Cases at the Supreme Court of the Russian Federation dismissed the company’s claim
“TNS Energo Nizhny Novgorod” PJSC approached the Supreme Court of the Russian Federationto invalidate Clauses 7, 30, 65 (1) of the Basic Principles of Pricing in the Field of Tariff Regulation in the Electric Power Industry.
The company argued that they are contrary to the Tax Code of the Russian Federation (Article 266) and the Federal Law “On the Electric Power Industry” that prevail. The company also stated that the appealed provisions of the Basic Pricing Principles have varying interpretation coupled with other enactments.
The Supreme Court of the Russian Federation disagreed with the company arguments and dismissed the claim of “TNS Energo Nizhny Novgorod” PJSC in full.
