Appeal Court confirmed legitimacy of FAS Order to reduce the heat energy tariffs in the Altai region
FAS continues actively monitoring decisions made by the regional tariff regulators
In 2016, the Antimonopoly Service monitored the tariffs set for combined generation by the subjects of the Russian Federation.
FAS exposed excessive levels of heat energy tariffs in the decisions of Altai regional regulator.
Based on those facts, FAS issued an Order 1 to the Altai Regional Department on State Regulation of Prices and Tariffs to abolish the decisions for the second half of 2016 and approve the new tariffs for the stations with combined generation under the maximum levels set by the antimonopoly authority.
The regional regulator filed a lawsuit challenging FAS Order. Moscow Regional Arbitration Court pointed out the legitimacy of the act issued by the Antimonopoly Service, and on 19 April 2017 the Appeal Court passed a similar ruling.
Earlier, Deputy Head of FAS Vitaly Korolev stated that FAS will continue monitoring decisions of regional tariff regulators. “There are several examples when abolishing such decisions led to reduction of tariffs for consumers. Also, positive judicial practice will be yet another element enabling enforcement uniformity”, said Vitaly Korolev.
