Participants of a cartel agreement were fined over 4 million RUB
Moscow OFAS held “Ecoservice” Ltd. and “Fenikstrade” Ltd. (former “DEKOLITE” Ltd.) administratively liable. “Ecoservice” is fined 1.25 million RUB for invovement in bid-rigging and the fine upon “Fenikstrade” was 2.9 million RUB.
Earlier FAS exposed collusion between “Ecoservice” Ltd. and “Fenikstrade” Ltd. (former “DEKOLITE” Ltd.) at auctions organized by “Zhilischnik Raiona Yasenevo” State Budgetary Institution.
In 2014 the budgetary institution organized three auctions for water supply, water drainage and supplying electric power for temporary storage of special equipment on “Golubinskaya St. The maximum contract price was 9.8 million RUB.
The cartel formed by the companies resulted in maintaining prices at auctions, as a result of which “DEKOLITE” Ltd. won all three auctions and concluded contracts for the total amount 9.1 million RUB.
Moscow OFAS established that at the auctions companies exchanged information in the interests of each other and used common infrastructure filing requests, price bids and singing contracts.
The sum of the fines upon each collusion participant is calculated based on the size of the proceeds of each company from selling all goods (works, services) in the year preceding the violations. The fine for an anticompetitive agreement upon legal entities is 10% - 50% of the initial maximum costs of the auction subject. Top executives of the companies also may be held administratively liable; the fine upon them will be 20,000 RUB – 50,000 RUB.
