FAS warned “Tomskgazprom” not to avoid supply contracts and created discriminatory conditions
The Federal Antimonopoly Service (FAS Russia) issued a warning to “Tomskgazprom” OJSC due to signs of violating Clauses 5 and 8 Part 1 Article 10 of the Federal Law “On Protection of Competition”: unreasonably refusing supply contracts for liquefied hydrocarbon gas (LHG), and creating discriminatory conditions.
The companies must eliminate signs of violations by:
- Sending draft LHG (LPG) supply contracts, with substantial conditions based on non-discriminatory principles and providing for allocation of the entire LPG volume, sold by “Tomskgazprom” OJSC, pro rata to the volumes specified in the offers (proposals, offers to the following companies: “SITEK” Ltd., “SIBGAZ” Ltd., “Gazprom Gazenergoset” JSC, “SIBAVTOVAZ” Ltd., “KTS-LOGISTIC” Ltd., “SIBGAZSET” Ltd., “SuccessKhimPlast” Ltd.
- Concluding LHG (LPG) supply contracts under non-discriminatory conditions with the companies specified in the first Sub-Clause, agreed to conclude LPG supply contracts
- Drafting and submitting to FAS for approval methods of pricing procedure, general principles for selling LHG on the wholesale markets in the Russian Federation
- Selling no less than 5% of the monthly production of liquefied hydrocarbon gases by “Tomskgazprom” OJSC through the exchange.
