“TNS Energo Nizhny Novgorod” PJSC failed to invalidate the Basic Pricing Principles on Tariff Regulation in the Electric Power Industry
The Appeal Collegium of the Supreme Court of the Russian Federation dismissed the company’s claim
“TNS Energo Nizhny Novgorod” PJSC asked the Supreme Court of the Russian Federation to invalidate Clauses 7, 30, 65 (1) of the Basic Pricing Principles on Tariff Regulation in the Electric Power Industry.
The company claimed that those norms were contrary to the Tax Code of the Russian Federation (Article 266) as well as the Federal Law “On Electric Power Industry”, which prevail. The company also stated that the challenged provisions of the Basic Pricing Principles lend themselves to varying interpretations in conjunction with other normative legal acts. The Supreme Court of the Russian Federation disagreed with the company’s arguments and dismissed the claim of “TNS Energo Nizhny Novgorod” PJSC in full.
