FAS reports that the Federal Law on amendments to some legislative acts of the Russian Federation is in effect

On 26 July 2017 No. 205-FZ Federal Law “On making changes to some legislative acts of the Russian Federation and invalidating particular provisions of legislative acts of the Russian Federation due to adopting the Federal Law “On Protection of Competition” came into force.

The Federal Law amends Article 3 of the Federal Law “On natural monopolies” in the part of the concepts of “goods”, “goods market”, “economic entities” and “group of persons”.

The Federal Law is designed to eliminate discrepancies between the provisions of the Federal Law “On banks and banking”, the Law of RSFSR [Russian Soviet Federative Socialist Republic] “On investment activity in RSFSR”, the Federal Law “On investment activity in the Russian Federation in the form of capital investments”, the Federal Law “On railway transport in the Russian Federation”, the Federal Law “On special protective, anti-damping and compensation measures in goods import”, the Federal Law “On the fundamental principles of regulating the tariffs of utility companies” and the Federal Law “On Protection of Competition”.

In particular, Article 32 “Antimonopoly requirements” of the Federal Law “On banks and banking”, the group of persons of a Russian producer in Part 8 Article 26 No.165-FZ Federal Law “On special protective, anti-damping and compensation measures in goods import” of 8 December 2003, etc, are further defined.

To avoid duplications between the Federal Law “On Protection of Competition” and other federal laws, the draft Law invalidates Article 35 of the Federal Law “On private pension funds”, Article 32 of the Law of the Russian Federation “The fundamental principles of the laws and regulations of the Russian Federation on culture”, Article 31 of the Law of the Russian Federation “On organizing insurance business in the Russian Federation”, Article 26 of the Federal Law “On gas supply in the Russian Federation”, Clause 35 Article 1 of the Federal Law “On amendments to the Federal Law on private pension funds”, Clause 13 Article 1 of the Federal Law “On amendments and additions to the Law of the Russian Federation “On organizing insurance business in the Russian Federation” and Article 35 of the Federal Law “On financial leasing”.
