FAS will accelerate implementation of the target model for obtaining construction permit in the regions

Representatives of the antimonopoly authority will join the Working Group of the Construction Ministry of the Russian Federation.

A training workshop on adopting a target model - “Obtaining construction and regional planning permit” for federal executive bodies and the local self-government bodies in the North Caucasus and Southern Federal Districts was organized in Essentuki.

Deputy Head of FAS Department for Control over Construction and Natural Resources, David Akopyan discussed the administrative appeal procedure in the construction industry, introduced in January 2016.

Now the antimonopoly body applies the so-called “fast-track procedure” (Article 18.1 of the Federal Law “On Protection of Competition”) to the complaints submitted by builders, design engineers and other businessmen involved in construction, against the authorities and network companies (7-14 days).

“Thus far, most complaints in the field of construction concern delays – 45 out of 51 complaints filed to the antimonopoly bodies”, pointed out the speaker.

As an outcome of joint efforts, it was decided that FAS representatives should be included in the Federal Working Group of the Construction Ministry to monitor implementation of the target model - “Obtaining construction and regional planning permit” – in the subjects of the Russian Federation.

The target model was approved by the Government to comply with the list of the instructions of the President of the Russian Federation based on the meeting of the State Council of 5 December 2016. It is designed to generate unified enforcement practice in construction across Russian regions and reduce the period required to obtain construction permits.

David Akopyan said: “The monitoring by the Construction Ministry has already revealed that in many regions and municipalities the regulatory framework has not been adjusted in line with the federal standards. It frequently leads to the violations that the antimonopoly body is countering”.
