FAS HELD CONSULTATIONS WITH INDIA COMPETITION COMMISSION
The subject matter was merger of “Bayer” and “Monsanto” - two global agro-technical companies
On 12 - 13 February 2018, FAS held consultations with representatives of India Competition Commission. They were based on waivers, submitted by the companies to Russia and India Competition Commission. The subject mater of consultations was a merger between “Bayer” and “Monsanto” - two global agro-technical companies, at the moment being considered by many jurisdictions, particularly, India and Russia.
In the course of bilateral negotiations, the parties discussed approaches to merger review, exchange information regarding the impact that the merger will have upon competition in Russia and India. FAS representatives answered questions form their Indian colleagues about preliminary conditions set to the companies in November 2017. In its turn, the Indian delegation informed FAS representatives about the progress in merger consideration.
Head of FAS Department for International Economic Cooperation, Lesya Davydova, commented: “The dialogue between antimonopoly bodies from different jurisdiction on cross-border cases and transactions are becoming very important. We are grateful to the companies for the confidentiality waivers, because it is through them the authorities can have an open conversation in order to set the most efficient conditions in both jurisdictions. We trust that the cooperation between Russian and Indian competition authorities on particular cases will continue in the future”.
