“MOSENERGOSBYT” UNLAWFULLY INITATED POWER SUPPLY RESTRICTION FOR A “TRANSNEFT” FACILITY

Moscow Arbitration Court confirmed legitimacy of reasonableness of the decision made by Moscow OFAS regarding “Mosenergosbyt”

 

Earlier Moscow OFAS ascertained the fact of abusing dominance by the provider of last resort in power supply to a company from the “Transeft” group of persons.

 

For instance, threatening to restrict power supply, “Mosenergosbyt” forced the company to pay a questionable debt for off-the-meter electric power consumption that actually did not take place.

 

Also, the provider of last resort initiated restricting energy supply with considerable breaches of procedures.

 

“In the absence of the definite fact of off-the-meter consumption, “Mosenergosbyt” failed to give an opportunity to the service receiver to protect its rights in any way and forced to pay the questionable debt by restricting power supply. The Court support to our conclusions is an important step towards full suppression of such actions of the monopolist”, pointed out Deputy Head of Moscow OFAS Nikita Poleschuk.

 

In the near future, officers of Moscow OFAS will open an administrative case to impose a fine for the above violation of the antimonopoly law.
