MOSCOW OFAS: FOUR COMPANIES FORMED A CARTEL AT 19 TENDERS
Moscow OFAS found elements of cartel agreement between tender participants for repairing Eramishantsev Clinical Hospital, Moscow Healthcare Department.
During two years “Intep” Ltd., “INTEGRA” Ltd., “CROWN” Ltd. and “QUINTA” Ltd. took part in 19 hospital tenders for the total amount - 127 million RUB. Two or three economic entities participated in all tenders, at the same time “CROWN” Ltd. and “QUINTA” Ltd. refused to compete to the benefit of “Intep” Ltd. or “INTEGRA” Ltd., as a result of which contracts with the ordering party were always concluded by “Intep” Ltd. or “INTEGRA” Ltd., at the price no higher than 6% below the initial contract price. Due to the companies’ actions, the ordering party procured repair works for two years at overrated prices.
Moscow antimonopoly body opened a case against “Intep” Ltd., “INTEGRA” Ltd., “CROWN” Ltd. and “QUINTA” Ltd. upon elements of violating Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition”. Liability for concluding anticompetitive agreements is specified in Part 2 Article 14.32 of the Code on Administrative Violations and is punishable by an administrative fine up to 50% of the initial tender value for legal entities and up to 50,000 RUB for top executives.
