COURTS OF THREE INSTANCES SUPPORTED FAS POSITITON ON PROTECTING FIFA SYMBOLS
Earlier FAS recognized the fact of infringing FIFA property rights by “Bavaria Brewing House” Group” Ltd. and “FAT Agrofirm” Ltd. in the course of a promotion campaign
On 18 June 2019, the Arbitration Court of the Moscow District supported the position of Moscow Arbitration Court and the 9th Arbitration Appeal Court, confirming legitimacy and reasonableness of the decision of the Antimonopoly Service regarding “Bavaria Brewing House” Group” Ltd. and “FAT Agrofirma” Ltd.
Earlier FAS recognized the fact of infringing FIFA property rights by “Bavaria Brewing House” Group” Ltd. and “FAT Agrofirm” Ltd. in the course of a promotion campaign. For instance, companies carried out promotion events to sell beer that they produce using markings that are similar to the FIFA trademarks to the degree of confusion, which creates an impression that the promotion action organizers are association with FIFA sport events and constitutes an act of unfair competition. The companies also raffled out tickets to FIFA 2018 World Cup final although at that time they did not had contracts with FIFA entitling them to act this way.
