NAZYVAEVSKY ELEVATOR FAILED TO EXECUTE FAS WARNING
The antimonopoly authority opened a case in the market of grain storage services
FAS had opened proceedings against “Nazyvaevsky Elevator” OJSC upon signs of violating Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition” after the company failed to execute FAS warning issued due to elements of violating the antimonopoly law in its actions: “Nazyvaevsky Elevator” had been avoiding a contract with an economic entity for storage and shipment of grain purchased by it from the state stocks.
FAS established that “Nazyvaevsky Elevator” OJSC has the dominant position on the market of services for storing grain acquired under the frame of selling materials values released form the Federal State Reserve Agency and place to the custodians. Thus, avoiding the contract by the company can be considered abusing dominance.
The Commission on investigating the antimonopoly case is scheduled on 10 September 2019.
Head of FAS Department for Control over Agro-Industrial Complex, Anna Mirochinenko commented: “FAS has opened a series of cases against elevators that store grain from the state reserves or the grain form the federal intervention fund. Elevators are infrastructure facilities on the grain market so their actions determine to a considerable degree its performance efficiency”.
