COURT CONFIRMED LEGITIMACY OF THE ACTIONS UNDERTAKEN BY THE FAS STAFF

Regional authorities approached judiciary to invalidate FAS order on the unscheduled inspection and actions of the FAS staff who obtained information and copies of documents during the inspection  

 

The Antimonopoly Service and Irkutsk OFAS started the inspections due to doubts whether actions of the regional authorities in the course of constructing a new terminal in Irkutsk airport were legitimate.

 

The inspected person, though, believed that the conduct of the officers of the antimonopoly bodies was illegal and asked the Court to protect the allegedly infringed rights.

 

Investigating the case, the Court concluded that the Antimonopoly Service had not exceeded its jurisdiction. The Court of First Instance confirmed legitimacy of the actions of the FAS inspection team, and the legitimacy of FAS order on the unscheduled on-site inspection of the Government of the Irkutsk region.
