DEVELOPERS OBTAINED CONSTRUCTION PERMITS AFTER THEY APPROACEHD FAS
FAS received complaints from “Skhodnya-10” and “Skhodnya-15” Housing-Construction Cooperatives against the Housing Policy Ministry of the Moscow region that had refused to grant permit to the developers for construction of two apartment blocks in Khimki.
According to Deputy Head of FAS Department for Control over Construction and Natural Resources, David Akopyan, based on the argument outlined in the claim, the Ministry refused to grant permit referring to absence of references to sanitary rules in the explanatory notes to the projects. At the same time, an expert examination of the projects confirmed that they meet the technical regulations.
Head of FAS Department for Control over Construction and Natural Resources, Oleg Korneev, informed that “the complaints were withdrawn on the 7th day of the “fast-track procedure since the parties settled and there was no need for FAS to issue a binding order. In the middle of August developers received construction permits”.
From 1 August 2019, the list of construction procedures, on which decisions of the authorities can be appealed to FAS under the fast-track procedure, is expanded. It concerns decisions of the authorities on establishing / changing zones with special condition for are use, for example, such protective areas of cultural heritage sites, safeguard zones for electric power facilities, railway zones, coastal protection, etc.
