ANDREY KASHEVAROV ABOUT VIOLATIONS RELATED TO INTELLECTUAL PROPERTY RIGHTS

The institution of warnings used in the antimonopoly law does not apply to such cases. FAS opens proceedings upon elements of violations right away

 

Speaking at 2019 International Digital Summit (Nizhny Novgorod, 26-27 September), Deputy Head of FAS Andrey Kashevarov said: "Rivalry in the part of intellectual property use is in all areas. IP is attacked, its protection means not only registering and acquiring patent rights but also guaranteed of suppressing unfair actions of competitors”.

 

He believes that violations of IP rights, particularly confusing, are a very serious issue.

 

Confusing is on the 2nd position by the number of unfair competition cases: "Unfortunately the figure increased for more than n75% in 2018".

 

In February 2019 FAS signed an agreement with the Corporate Counsel Association e4nabling the latter to give expert opinions to FAS with regard to unfair competition.

 

"Digitalization and related development of economic relations in the business field, the need to evaluate them us the most pressing and vital for us”, stressed Andrey Kashevarov.

 

FAS received complaints from online-resource owners about unauthorized copying of information form their sites and shall assess whether copying of information put by user in open access is legal and does not constitute unfair competition.

 

"One of the primary tasks is to study barriers in information fields when market players exclude competitors from demand formation. All this affects consumers"explained Deputy Head of FAS.

 

Among barriers to free movement of goods between jurisdictions, he mentioned actions of “parallel importers”, and reminded that FAS continues working on legal norms to protect this economic tool in order to intensify competition. There are investigations and cases on signs of abuse in this area, but no final decisions are made yet.
