FAS EXPOSED ELEMENTS OF AN ANTICOMPETITIVE AGREEMENT FOR MEDICAL WASTE DISPOSAL
FAS opened a case against the Ministry of Healthcare of the Rostov region, №.2 Regional Clinical Hospital, No.20 City Hospital of Rostov-on-Don, №4 Specialized Infant Home, Rostov-on-Don, Town Hospital for Emergency Medical Care (Novocherkassk) and “Centre 100 Rostov-on-Don” Ltd.
The antimonopoly body exposed elements of an anticompetitive agreement between a regional authority (the Ministry of Healthcare of the Rostov region), the auction organizers – “№ 2 Regional Clinical Hospital” State Budgetary Institution of the Rostov region, “№ 20 City Hospital of Rostov-on-Don” State Budgetary Healthcare Institution, “№ 4 Specialized Infant Home, Rostov-on-Don”, State Budgetary Healthcare Institution of the Rostov region, “Town Hospital for Emergency Medical Care (Novocherkassk)” Municipal Budgetary Healthcare Institution; and an economic entity (“Centre 100 Rostov-on-Don” Ltd.), prohibited by Article 16 of the Federal Law “On Protection of Competition”.
FAS exposed elements of the violation in procurement procedures for the right to provide the services of medical waste disposal in the Rostov region in 2017-2018.
FAS also sees elements of an anticompetitive agreement between the auction organizers – “№ 2 Regional Clinical Hospital” State Budgetary Institution of the Rostov region, “№ 20 City Hospital of Rostov-on-Don” State Budgetary Healthcare Institution, “№ 4 Specialized Infant Home, Rostov-on-Don”, State Budgetary Healthcare Institution of the Rostov region, “Town Hospital for Emergency Medical Care (Novocherkassk)” Municipal Budgetary Healthcare Institution and an economic entity (“Centre 100 Rostov-on-Don” Ltd.) prohibited by Clause 1 Part 1 Article 17 of the Federal Law “On Protection of Competition”.
Head of FAS Anti-Cartel Department, Andrey Tenishev commented: “Exposing and suppressing anticompetitive agreements in healthcare is one of FAS priorities. Special attention should be paid to violations committed by federal and regional authorities”.
