APPEAL COURT CONFIRMED LEGITIMACY OF THE ACTIONS UNDERTAKEN BY FAS STAFF INSPECTING

The regional authorities asked to rule that actions of FAS officers, who obtained information and copies of documents in the course of an inspection, were illegal

 

The Antimonopoly Service started an inspection due to some signs of violating the law by Irkutsk regional authorities in the project for constructing a new terminal in Irkutsk airport.

 

The inspected person, however, regarded the actions of the antimonopoly body unlawful and filed a lawsuit to protect the allegedly infringed rights.

 

The Court of First Instance fully dismissed the claim of the Governor’s Office and the Government of the Irkutsk region.

 

The claimants disagreed with the ruling of Court of First Instance and lodged an appeal.

 

Having considered the materials, the 9th Arbitration Appeal Court upheld the ruling of Court of First Instance and dismissed the appeal, confirming legitimacy of the actions undertaken by the members of the FAS inspection.
