FAS EXPOSED VIOLATIONS AT AN AUCTION FOR PLACING ADVERTISING STRUCTURES IN ELECTROSTAL

The operator violated the regulations on an e-trading site – it failed to ensure site performance during the auction

 

The FAS Commission passed a decision and issued an order following a complaint filed by “VinEx” against actions of the operator of an e-site – “RST-ender” Ltd. in the course of an auction organized by Electrostal Town Department for Developing Industry, Investment Policy and Advertising, the Moscow region. The initial trading price for all 16 lots was around 9.6 million RUB.

 

According to Deputy Head of FAS Department for Control over Construction and Natural Resources, Oksana Malaya, the complaint concerned malperformance of the e-trading site which prevented the complainant to take full participation in all auction lots. To corroborate its argument and the fact of failure at the e-trading site, the company presented a video-record of the auction and actions undertaken at the e-trading site, made using the “Independent register” program module.

 

“FAS has studied the video-recording presented by the claimant and has found that the indicator was signaling in the window of the Independent register” information system that the site was not-available for along period of time allocated for the auction. Making the decision and issuing the order, FAS has taken into account 3 more complaints from auction bidders regarding performance of the e-trading site”, concluded Oksana Malaya.

 

Having completed the investigation, FAS found that the e-site operator violated the Regulations of the electronic trading site in the part of failure to support the site performance during the auction.

 

“The auction organizer is ordered to abolish the auction protocol and continue  the auction procedure from the last price offers while the e-site operator must ensure uninterrupted auction procedure”, said Head of FAS Department for Control over Construction and Natural Resources, Oleg Korneev.
