FAS DISCUSSED ASPECTS OF FULFILLING REQUIREMENT ON PRE-INSTALLEMENT OF RUSSIAN SOFTWARE
Discussions of a draft act of the Government of Russia, which will take into account the submitted proposals, are scheduled in January 2020
On 23 December 2019, the Working Group of FAS Expert Council on Information Technologies discussed enforcement of № 425-FZ Federal Law “On amendments to Article 4 of the Federal Law “On consumer rights protection” of 2 December 2019.
In view of the earlier discussion on pre-installment of Russian software on user devices, the participants discussed the ways to fulfill the requirements set by the Russian law.
Proposals were put forward on a list of technically sophisticated goods, a list of software classes and possible pre-installment methods.
The experts also discussed some aspects related to production and sale of technically sophisticated goods with pre-installed software, particularly, options for enabling an efficient mechanism of applying the pre-installment procedure as well as methods of leveling potential risks.
Pre-installment will be discussed engaging all market participants – equipment manufacturers, distributors, sellers, software developers, communications providers, associations, developers of operational systems and representatives of executive bodies. In this context, the interests of all market participants and the highlighted aspects of re-installing software will be taken into account.
Experts should forward their proposals on all aspects of software pre-installment to FAS by 26 December 2019. Discussions of the draft act of the Government of the Russian Federation are scheduled for January 2020. The act will be drawn up in view of the submitted proposals.
