INTERACTION BETWEEN FAS AND THE EEC ENABLED THE EEU COURT TO MAKE AN OBJECTIVE JUDGEMENT
FAS carried out inspections upon elements of violating the common rules of competition by “Delrus” CJSC and “Medical company” Ltd. on the basis of a reasoned submission by the Eurasian Economic Commission in 2018
Investigating the case, the Panel of the Eurasian Economic Commission made a decision 1 in view of the inspection findings and ascertained the fact of an agreement between между “Delrus” CJSC and “Delrus RK” LLP and its implementation on geographically dividing the market of services for calibrating ultrasound sensors for FibroScan.
The companies disagreed with the conclusions reached by the Panel and approached the Court of the Eurasian Economic Union.
Having considered the statement, the Court Panel pronounced that the decision of the Eurasian Economic Commission conforms to the Treaty on the Eurasian Economic Union.
Head of FAS Anti-Cartel Department Andrey Tenishev pointed out: “Interaction between FAS and the Eurasian Economic Commission is not limited to unscheduled inspections. Further on, competent officers take part in investigating cases upon signs of violating the common competition rules and are involved in consultations between the Union member-states”.
