ACUTIONS RESULTS ARE ABOLISHED IN VOLGOGRAD DUE TO A COMPLAINT FILED BY A POTENTIAL BIDDER
FAS exposed violations in the actions of “Unified Electronic Trading Site” JSC during an auction for selling a garage stall in the historic district of Volgograd and found that a complained of a Volgograd resident about an unlawful dismissal of his auction application was justified
In December 2019, the Volgograd Regional Office of Rosimuschestvo[the Federal Property Management Agency] published information in the internet about an auction for selling a garage stall. The auction was supposed to take place in January 2020 on the basis of the “Property Privatization” e-site of “Unified Electronic Trading Site” JSC.
A resident of Volgograd expressed a desire to take part in the auction, paid the advance payment required by the electronic trading site, but in the end his application was rejected by the organizers because of insufficient funds on the applicant’s account for participating in the auction. Then the man complained to the Federal Antimonopoly Service.
Deputy Head of FAS Department for Control over Construction and Natural Resources, Oksana Malaya, summarized the decision of the antimonopoly authority: “The auction organizer – the Volgograd Regional Office of Rosimuschestvo – gave details of a special organizer’s account in the notice for advance payment in accord with the norms of the law. Therefore, “Unified Electronic Trading Site” JSC unlawfully requested the applicant to put funds on his account and breached the auction procedure”.
Upon considering all materials submitted FAS and hearing explanations from an operator’s representative, the FAS Commission found that “Unified Electronic Trading Site” JSC violated the Federal Law “On Protection of Competition” [1].
Head of FAS Department for Control over Construction and Natural Resources, Oleg Korneev, stated: “The e-site operator was ordered to adjust the Regulations on the procedures for sale and lease of state and municipal property in line with the current law”.
