THE FAS RUSSIA PREPARED RECOMMENDATIONS ON COMPLIANCE WITH THE ANTIMONOPOLY LEGISLATION

Recommendations were prepared in order to establish uniformity in applying the provisions of Article 10 of the Law on Protection of Competition and Article 9.21 of the Code of Administrative Offence

Every year, the Federal Antimonopoly Service conducts analytical work in order to provide methodological assistance to Regional Offices of the FAS Russia.

In accordance with the Plan for Methodological Assistance to the Regional Offices of the FAS Russia in 2020, the Department for Regulation over Electric Power Industry has prepared the following recommendations:

- on initiating and considering cases on violation of Antimonopoly legislation on the facts of violation of the Guidelines for retail electricity markets functioning, approved by the decree of the Government of the Russian Federation of 04.05.2012 No. 442, with regard to violation of the procedure for inspections of settlement metering devices for electric energy and identifying unaccounted consumption,

- on application of Rules of technological connection of power receivers of consumers of electric energy to electric networks, concerning features of connection of gardeners’ non-commercial associations, garage cooperatives, household building and other objects of capital construction.

“The recommendations prepared are based on the decisions of the Regional Offices of the FAS Russia that have entered into legal force and judicial decisions on the issues noted and are of great importance for establishing uniformity in the antimonopoly legislation application. Familiarization with recommendations will be useful both for consumers of electric energy, and for guaranteeing suppliers and network organizations,” said Alexey Voronin, Deputy Head of the Department for Regulation over Electric Power Industry of the FAS Russia.
