“ORTHOPAEDISTS” FULFILLED THE FAS REMEDIES

The companies stopped the cartel agreement and the coordination of the prices of their distributors

It should be reminded that the Federal Antimonopoly Service found Trives Trade LLC, Medexpert LLC,  Optomed LLC, Maltri LLC, ORTHO LLC and Ecoten LLC  guilty of violating the Law on Protection of Competition* in the wholesale of orthopedic products. Companies set recommended prices and sanctions for non-compliance with them in order to maintain the highest possible cost of products sold. The Authority imposed fines on organizations in the amount of more than 31 million rubles and issued instructions on the termination of the anti-competitive agreement and actions aimed at ensuring competition.

In July 2021 the Ninth Arbitration Court of Appeal of Moscow recognized the decision of the FAS Russia in respect of Trives Trade LLC, Medexpert LLC,  Optomed LLC, Maltri LLC, ORTHO LLC and Ecoten LLC  as legitimate.

Three companies** - "Maltri", "ORTHO" and "Ecoten", after the decision of the Court of Appeal, fulfilled the issued instructions and notified the FAS Russia.

The Authority is waiting for the relevant information from Trives Trade LLC.

** The FAS Russia found the companies Medexpert LLC, Optomed LLC guilty. However, they were liquidated before the decision of the FAS Russia was made. The case against these companies was dismissed.
