STATE DUMA ADOPTED IN THE THIRD READING THE DRAFT LAW OF FAS ON THE OPTIMIZATION OF ANTIMONOPOLY CONTROL OF SMALL AND MEDIUM-SIZED BUSINESSES

Earlier, FAS proposed to double the revenue limits of economic entities to reduce antimonopoly control. 

To do this, it is planned to amend the Law on Protection of Competition and the Law on Trade. According to the draft law a company cannot be recognized as a dominant economic entity if its annual revenue does not exceed 800 million rubles.

If the relevant law is adopted, when the revenue of the acquired company under the merger-acquisition transaction does not exceed 800 million rubles, approval of the antimonopoly authority will not be required*. 

Currently the threshold value of revenue acquired under the company's transaction for approval of FAS is 400 million rubles.
