FAS: 18 FEDERAL LAWS WILL BE DEVELOPED BY 2025 WITH THE PARTICIPATION OF THE AUTHORITY
It was presented by the State Secretary - Deputy Head of the FAS Russia- Mr. Sergey Puzyrevsky at the 5th International Scientific and Practical Conference of the FAS Russia and the journal «Competition Law».
The Deputy Head of the Authority announced trends in changes in antimonopoly legislation and noted that the National Competition Development Plan approved in 2021 for the period 2021-2025 identified 49 systemic and sectoral measures in 15 sectors of the economy, including the development of 18 federal laws and a number of regulatory legal acts.
Currently, the State Duma has adopted draft laws developed by the FAS Russia aimed at reducing the administrative burden on small and medium-sized businesses. This is a bill providing for an increase in the threshold values of annual revenue from 400 to 800 million rubles. As well as the draft law on ensuring the possibility of paying half the amount of the fine in case of administrative liability for concluding anti-competitive agreements.
Earlier, an important change in the legal regulation was also the introduction of amendments to the Article 1360 of the Civil Code of the Russian Federation, which provide the possibility of restricting the patent rights of the copyright holder in order to protect the rights of citizens to medical care and ensure the security of the state.
For the first time, the Government of the Russian Federation has issued a compulsory license to one of the Russian enterprises for the production of a foreign antiviral medicine «Remdesivir» used in the treatment of a new coronavirus infection.
In addition, the Authority introduced amendments to the Law on Protection of Competition related to the introduction of the antimonopoly compliance system by business entities. Earlier, as part of the implementation of the National Plan, which was in effect until 2020, the introduction of antimonopoly compliance in government bodies at the federal and regional levels was ensured. As a result, the number of violations of antimonopoly legislation by authorities at all levels has halved.
Work in the field of tariff regulation was also noted. The Authority has prepared and submitted to the Government of the Russian Federation a draft Federal Law “On the Basics of State Regulation of Prices (tariffs)”, which will ensure uniform principles and rules of tariff regulation, form mechanisms to reduce costs, stimulate savings.
