CASSATION SUPPORTED FAS IN THE CASE OF THE ROAD CARTEL IN THE NIZHNY NOVGOROD AND CHELYABINSK REGIONS
The Arbitration Court of the Moscow District recognized the decision of FAS against Firm Magistral LLC, Nizhegorodavtodor LLC, Impulse LLC, Nizhavtodorstroy LLC and UralDorStroy LLC as legitimate. Earlier, the position of the authority was supported by the courts of the first and appellate instances.
In the period from 2018 to 2019, participating in procurement procedures for the repair of highways in the Nizhny Novgorod and Chelyabinsk regions, organizations concluded an anticompetitive agreement, according to which they jointly refused to reduce the price at auction or to participate in competitive procedures in favor of a predetermined participant. The total amount of contracts was over 3.8 billion rubles.
It should be noted that the auctions for the repair of highways were held within the framework of the national project "Safe and High-quality Highways".
The offenders were held administrative liable in the form of fines totaling more than 398 million rubles.
