FAS: BUSINESS MODELS OF RUSSIAN COMPANIES CAN BE REVISED

At the same time, the Authority's approaches to the formation of effective competitive relations will be changed along with the development of  new market conditions

The Head of FAS Maxim Shaskolskiy talked about it at the SPIEF session on the development of digital markets.

The focus of the state and business on favorable and effective development in competition with transnational giants made it possible to work out tools for self-regulation of Russian digital markets without strict regulatory intervention.

So, this year, the largest IT companies have joined the Principles of Interaction of Digital Market Participants developed at the Authority's site. The document illustrates the possibility of using “soft law” tools and reflects the foundations for the formation of open and non-discriminatory business conditions.

In May, FAS completed the consideration of the case against Yandex on the fact of prioritization in search. The Arbitration Court of Moscow approved a settlement agreement between FAS, Yandex LLC and the applicants in the antimonopoly case. The court noted the execution of the warning of FAS, as well as execution of actions by Yandex aimed at the development of markets in a competitive environment.

According to the service, such a successful and rapid resolution of the situation is optimal. It is worth noting that, for example, the European Commission considered a similar case against Google for about 7 years and the court proceedings are still ongoing.

Now the Authority continues its policy of creating an open and transparent environment for the development of the market in conditions of fair competition.

Thus, the regulations and requirements of the Authority issued as a result of the consideration of cases against Google, Microsoft and Apple are aimed at ensuring non-discriminatory access of Russian developers to the “key digital capacities” of global corporations. It allows to properly ensure equal competitive conditions both in the national and in the global market.

At the same time, the remedies issued by FAS for Booking and Yandex.Taxi (as part of the merger review with Uber) set standards for reasonable, transparent and conscientious relations with consumers aimed at reducing barriers to market access in conditions of high network effects of the market.

In the current economic situation, the business models of Russian companies can be revised. Possibility of changing the service's approaches to the formation of effective competitive relations will be tackled along with the development of new market conditions.
