GOVERNMENT OF THE RUSSIAN FEDERATION APPROVED DRAFT OF THE "FIFTH ANTIMONOPOLY PACKAGE"
The draft laws included in it are aimed at restraint of the abuse of dominant position by digital platforms
The "fifth antimonopoly package" extends the prohibition on abuse of dominant position to marketplaces and aggregators if they have significant impact on adjacent markets and their revenue for the last calendar year exceeds 2 billion rubles.
A new condition for monitoring transactions of economic concentration in digital markets is also being established: if the transaction exceeds 7 billion rubles, it must be agreed with FAS Russia.
In addition, amendments are being made to the Code of Administrative Offences of the Russian Federation – now the use of digital algorithms in cartel agreements will be considered as an aggravating circumstance when assigning administrative responsibility. The draft laws also proposes to strengthen administrative responsibility for repeated failure to comply with the instructions of FAS Russia.
It is planned that the "fifth antimonopoly package" will be submitted to the State Duma of the Russian Federation in the near future. Its adoption will increase the effectiveness of antimonopoly control measures in modern markets and ensure consumer protection from abuse of market power by digital monopolies.
